Abdo's attorneys want confession thrown out

WACO -- Defense attorneys representing an AWOL soldier accused of plotting an attack on Fort Hood say they want his confession to be thrown out.

A motion was filed late Thursday asking Judge Walter S. Smith to deny prosecutors from using the confession made by Naser Jason Abdo stating the FBI agents did not give him the right to legal counsel before the confession was made.

The motion also asks for the dismissal of evidence obtained as a result of the July 27, 2011 arrest claiming he was not read his Miranda rights.

A hearing is set for April 20 and the trial date is set for May 21.
