WACO -- A mistrial in the case of a Waco man with a history of mental illness charged with shooting an officer.
Officials say a juror communicated with an outside source so the judge was forced to delcare a mistrial.
Testimony began this morning for Noy Moten, 65, for attempted capital murder and aggravated assault against Officer Craig Mrosko in September of 2007 while they were investigating a domestic disturbance.
A new trial date has been set for January 9th.
