COLLEGE STATION -- The constable deputy already charged with kidnapping a 19-year old College Station girl is under arrest for the second time in two and a half weeks.
Agustin Rubio is under arrest after new allegations surface that he tried to sexually assault another woman.
Rhonda Seaton with the College Station Police Department said, "The victim told us that on June 25th, a little bit after one o'clock, she and a friend of hers were at the Whataburger in the 3100 block of Texas Avenue in Bryan."
Then the two girls were arrested for minor in possession of alcohol.
Rubio brought the victim to the administration building in his patrol car where he then lead her into the south entrance with his key card to let her use the bathroom.
According to court documents, it was there in the bathroom where he assaulted her.
"He came inside the restroom, took some items off his duty belt and told her that he could help her get out of jail and asked what she was willing to do to get out of jail," said Seaton.
After the alleged assault, Rubio handcuffed the woman and took her back to the car where she was able to get a hold of her cell phone.
"She sent a message to her friend or made a note on her notepad that "he basically tried to rape me" and showed that to her friend so her friend would know what was going on," Seaton said.
When Rubio dropped the girls off at the jail, he put $80 in the victim's purse and made reference to it "being a blessing."
Fox 28 spoke with Rubio's former boss, Constable Donald Lampo, who declined on an camera interview but said he's completely shocked by the charges.
