UPDATE: Man out of hospital after deadly shooting in North Waco

WACO -- Police have arrested the man in a murder March 27. Tony Sanders was in the hospital after he shot and killed his girlfriend's son, Timothy Smith.

Smith's uncle, Marvin Smith, beat Sanders nearly to death after he shot his nephew.

It happened in the 2700 block of 24th street in Waco.

Sanders was released from the hospital Monday, and he is now in McLennan county jail.

WACO -- A man is struggling to stay alive in a Waco hospital, another is behind bars and a third man is dead. Now, police are trying to figure out what lead up to the shooting that killed 28-year-old Timothy Smith.

It happened on the 2700 block of N. 24th St. It was a very different scene Monday, one day after police say a man shot his girlfriend's son and was nearly beaten to death by the victim's uncle.

Neighbor Sylvester Dowdy has lived in the Waco neighborhood for years and couldn't believe it.

"To hear of a death that's tragic like that is somewhat of a throwback," said Dowdy.

Police say Tony Sanders shot his girlfriend's son, 28-year-old Timothy Smith, just after 3:00 Sunday morning.

By the time police arrived, Timothy Smith had already been taken to the hospital, and they found the suspected shooter unconscious inside.

Police say Tony Sanders was unconscious because the victim's great uncle, Marvin Smith, had severely beat him, but they aren't sure how it got that far.

"Emotions can take over in that. Was this a self defense issue? Was it a retaliatory move? At this point those questions are still up in the air because it's so fresh," said Sgt. Patrick Swanton with Waco Police.

Neighbors aren't sure what caused the deadly argument either. Dowdy lost his grandson in an East Waco shooting a couple of months ago and says he knows it couldn't have been worth it.

"This is a life. You know, something that you can't give back," said Dowdy. "It hurts those involved, it hurts those that do it because they have a price to pay behind it."

Paying the price: the victim's uncle, Marvin Smith. He is charged with attempted murder after beating Tony Sanders.

As for the suspected shooter and mother's boyfriend, Tony Sanders, he's in the hospital tonight with blunt force trauma to the head.

Timothy Smith died in the hospital from several gunshot wounds.
