A Bryan man who's been on death row since 2003 has been granted a competency hearing by the Texas Court of Criminal Appeals.

33-year-old Marcus Druery was found guilty of capital murder for the 2002 Halloween robbery and murder of 20-year-old Skyylar Browne.

Druery's attorneys filed a request asking that his mental state be evaluated after he was sentenced to die last August because he's schizophrenic..

That grant was denied by a Brazos County judge but that decision was overturned Wednesday by an appeals court who says Druery should get the hearing.

A date hasn't been set.
