Former students suing 12th Man Foundation over Kyle Field seats

Some former Aggies aren't happy with the re-seating process for the new redeveloped Kyle Field and now they're suing the 12th Man Foundation because of it.

We've all seen the plans for the new and improved Kyle Field but not everyone is happy with it and now some former Aggie students are suing the 12th Man because they say the foundation isn't honoring their contract.

The plaintiffs say they gave A&M an endowed scholarship in return for keeping the same second deck seats at Kyle Field every football season.

Now with the new redevelopment, those seats will become a club and suite area and the plaintiffs will have to move to either the first or third decks.

An injunction hearing has been set for August in Houston in an attempt to stop the foundation from selling the seats they say belong to them.
