Killeen PD conducting 'special details' pertaining to the loud noise ordinance

The Killeen Police Department is conducting periodic special details pertaining to the loud noise ordinance. This detail is a result of the numerous complaints from citizens regarding loud music and officers will be issuing citations to those who violate this ordinance.

Noise Nuisance means any loud, irritating, vexing, disturbing, or unreasonable sound which causes distress, annoyance, discomfort or injury to or which interferes with the comfort or repose of any reasonable person of ordinary nervous sensibilities in the vicinity or hearing thereof, or any sound which endangers or injures the safety or health of humans or animals, or any sound which interferes with the physical well-being of humans or animals, or any sound which endangers or injures person or real property.

Loud Noise Ordinance – Section 16-77 A person may not:

(a) Make noise or play a musical instrument or other equipment plainly audible to a nearby business or residence during the nighttime.

(b) Operate, permit, or cause the operation of any device that creates vibration which is above the vibration perception threshold of an individual at or beyond the property of the source if no private property or at fifty (50) feet from the source if in a public space or public right-of-way.

(c) Create, generate, produce, or emanate an unreasonable noise or noise which, by its manner, volume, intensity, or duration annoys, distresses or disturbs the comfort or repose of any reasonable person or ordinary nervous sensibilities within.

The fine for a first time loud music violation is $500, any subsequent violation may result in an arrest.

The weather is getting warmer and people are outside more, we are asking the citizens to be mindful of their music and the consideration of others in the area.

I live in Killeen and the home next to me was destroyed by fire a few months ago. The house is being rebuild by a construction company. The construction workers have been doing repairs on this house for the last two months. These people are hammering, sawing and running the generator outside of the house until 4:00am in the morning when police was called. Last night it was 11:00pm. The noise is driving us crazy. is this legal for home builders to work this late at night? Do I have rights too?
