Waco, Texas — A McLennan County jury has acquitted a registered sex offender of three sexual abuse charges stemming from a 2011 case.
John David Schwarck, 41, was found not guilty of one count of aggravated sexual assault of a child and two counts of indecency with a child by contact.
“Due to the fact that this defendant has additional pending criminal matters with our office, we are unable to comment on this matter other than to say we respect the jury’s verdict,” said Gabrielle Massey, Assistant District Attorney of the jury's verdict.
Schwarck was arrested in December 2012, after officers issued a warrant for his arrest following an investigation. A 12-year-old girl reported she was sexually assaulted at a Bruceville-Eddy home in May 2011. The victim told a friend, and she was eventually interviewed by CPS caseworkers which spurred the police investigation.
Schwark has two felony convictions already for failure to register as a sex offender. He also has another failure to register charge pending in McLennan County.
